The Archive

Olfactory Archive is a marketplace where independent perfume brands list physical fragrances for sale and buyers discover and purchase them. We provide the platform; brands are responsible for their own products, and buyers purchase directly from them.

During the pre-launch period, parts of the catalogue may show clearly labelled demonstration entries that illustrate the Archive’s format. Demonstration entries are not offered for sale, and the brands pictured are not affiliated with, and do not endorse, the Archive.

Eligibility and accounts

You must be able to form a binding agreement where you live to use the Archive. During our pre-launch period, access is by invitation. You are responsible for the accuracy of your account details and for keeping your credentials secure.

Acceptable use

You agree not to:

• list or sell anything unlawful, unsafe, counterfeit, or that you do not have the right to sell;
• misrepresent a fragrance, its composition, or its provenance;
• infringe anyone’s intellectual property or privacy;
• interfere with the Archive’s security or normal operation.

Buying and selling

Purchases and sales are also governed by our Buyer Terms, Seller Terms, and Refund & Returns policy. Payments and payouts are processed by Stripe under its own terms.

Intellectual property

The Archive’s name, design, and original content are owned by MYCCA Inc. Brands retain rights to their own names, images, and listings and grant us a limited licence to display them on the Archive. See our Intellectual Property & DMCA policy for copyright concerns.

Disclaimers

The Archive is provided on an “as is” basis. We do not manufacture the fragrances sold and make no warranty about products listed by brands. To the fullest extent permitted by law, we disclaim implied warranties and are not liable for indirect or consequential damages arising from your use of the Archive.

Termination

You may stop using the Archive at any time. We may suspend or end access if these terms are breached or to protect the Archive, its brands, or its buyers.

Governing law

These terms are governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-laws rules. The exclusive venue for disputes is the state and federal courts located in California, and, where permitted, disputes will be resolved individually rather than as part of a class action.

Changes

We may update these terms as the Archive develops. Continued use after an update means you accept the revised terms.
